RERA does not require an “Agree” or “Accept” on real-estate websites. There is no provision under the RERA Act or its rules that mandates users to agree to terms or disclaimers before accessing a project website. This is why many well-known real-estate developers do not use an agree banner.

Most real-estate websites instead display a cookies or privacy policy banner, which is related to data-privacy compliance under Indian laws such as the IT Act and the Digital Personal Data Protection Act. This banner is used to inform users about data collection and tracking and is not connected to RERA compliance.

An agree or disclaimer popup is sometimes used voluntarily by developers as an additional legal safeguard, but it remains optional. Many developers avoid it because it can affect user experience, while a footer disclaimer and proper disclosures are considered sufficient.

In summary, RERA focuses on truthful disclosures and transparency, not on mandatory agree banners. Cookie consent banners are for data-privacy compliance, whereas disclaimers are a precautionary legal measure and not a statutory requirement under RERA.
